This study aims to explore legal requirements for regular updates to open data sets in Ukraine and mechanisms for overseeing compliance. It uses formal legal analysis and examines the practice of the Ukrainian Parliament Commissioner for Human Rights and court decisions. Information holders must update data regularly but may set the frequency within statutory limits. The maximum feasible frequency should reflect source data creation and modification cycles, which the shortest prescribed interval may not match. Oversight is complicated by the absence of a separate administrative offence for failure to update. The Commissioner may require remedial action through a submission, but liability in such cases concerns non-compliance with its lawful requirements. Courts differ on whether to order regular updates in the future. Further research should assess the need for administrative liability for failure to update and appropriate judicial remedies for non-compliance with this duty.
